1. Acceptance of Terms
By accessing or using MusicWrite ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users including free, Listener, Creator, and Pro plan subscribers.
2. Account Registration
You must be at least 13 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration and keep it up to date.
3. Subscription Plans & Billing
MusicWrite offers a free tier and paid subscription plans (Listener, Creator, Pro). Paid plans are billed monthly through Stripe. Subscriptions automatically renew unless canceled. Cancellations take effect at the end of the current billing period — you retain access to paid features until then. We do not offer refunds for partial billing periods.
Song generation quotas reset on the 1st of each calendar month. Unused quota does not carry over.
4. Intellectual Property & Ownership
Songs you generate on MusicWrite are owned by you, subject to the limitations below. Free and Listener plan users may use generated songs for personal, non-commercial purposes only. Creator plan users may use songs for commercial purposes up to individual content creator scale. Pro plan users receive full commercial licensing including monetization rights on streaming platforms.
MusicWrite retains a non-exclusive license to display public songs on the platform and use anonymized data to improve the service.
5. Prohibited Content
You may not use MusicWrite to generate content that: infringes on third-party intellectual property; contains explicit sexual content involving minors; promotes violence, hatred, or terrorism; violates applicable laws; or is designed to deceive or defraud others. We reserve the right to remove content that violates these guidelines and suspend accounts in egregious cases without refund.
6. AI-Generated Content Disclaimer
MusicWrite uses third-party AI models (Google Gemini, Lyria 3 Pro) to generate music and lyrics. We do not guarantee the originality, accuracy, or fitness for any purpose of AI-generated content. You are responsible for reviewing content before any commercial use. MusicWrite is not liable for claims arising from similarities between AI-generated content and existing works.
7. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform maintenance, updates, or make changes to the Service at any time. We are not liable for losses resulting from service interruptions, including failed song generations or temporary unavailability.
8. Limitation of Liability
To the maximum extent permitted by law, MusicWrite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our aggregate liability to you for any claims shall not exceed the amount you paid us in the 3 months preceding the claim.
9. Termination
You may terminate your account at any time from account settings. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your right to access the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
11. Changes to Terms
We may update these Terms from time to time. We will notify you at least 14 days before changes take effect via email. Continued use after the effective date constitutes acceptance. Contact us at legal@musicwrite.net with any questions.
